The terms and conditions governing your use of Shotelle

Welcome to Shotelle. By accessing or using the website photoshootgenerator.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the Service.

1. The Service

Shotelle is a web-based AI photography studio for e-commerce sellers. You upload photos of your garments or products — and, optionally, reference model photos — and the Service uses generative artificial intelligence models to produce product imagery such as on-model shots, lifestyle scenes, and white-background catalog photos.

Underlying AI Models Disclosure

The Service is powered by industry-standard generative AI models. Depending on the generation task and feature selected, underlying models include:

  • Flux (developed by Black Forest Labs) — utilized for high-resolution visual generation, textural fidelity, and background scene synthesis.
  • Nano Banana / Google Gemini — utilized for multimodal visual comprehension, on-model virtual try-on, and garment drape preservation.
  • OpenAI GPT Image — utilized for creative visual composition and scene rendering.
  • Cloudflare Workers AI (including LLaVA and Llama models) — utilized for image captioning, taglines, and distributed inference tasks.

We may add, update, or replace underlying models over time to improve output quality. AI output varies with your inputs, and results may not perfectly reflect the exact colors, fit, or materials of your physical products. We may modify, suspend, or discontinue any part of the Service at any time.

2. Accounts

You need an account to purchase credits, manage subscriptions, and keep your results. Free trial credits may be offered to new users so you can try the Service before purchasing.

You are responsible for providing accurate account information, safeguarding your password, and for all activity that occurs under your account. Notify us immediately at support@photoshootgenerator.com if you suspect unauthorized use of your account.

3. Eligibility

You must be at least 13 years old to use the Service. If you are a minor, you may use the Service only with the involvement of a parent or guardian, who must review and accept these Terms on your behalf and supervise any purchases.

4. Credits, Subscriptions, and Payments

The Service uses a credit system. Generating images consumes credits.

  • Free trial credits. We may grant free credits to eligible new users. Free credits are for trying the Service, have no cash value, and may be adjusted or discontinued at any time.
  • Subscriptions. Subscription plans grant credits at the start of each billing cycle. Credits granted in a billing cycle expire at the end of that cycle and do not roll over. Subscriptions renew automatically until cancelled, and you may cancel at any time; cancellation takes effect at the end of the current billing period.
  • Purchased credit packs. One-time credit packs never expire for as long as your account is active and in good standing.
  • Billing. Purchases require an account. Prices are listed in USD and include applicable taxes unless stated otherwise. Price changes do not affect credits you have already purchased or your current billing cycle.
  • General. Credits are personal to your account, non-transferable, and have no cash value. If we suspend or terminate your account for a violation of these Terms, any unused credits are forfeited. Unauthorized chargebacks may result in your account being frozen.
  • Refunds. If you believe a charge was made in error, contact us at support@photoshootgenerator.com and we will review your case. Except as required by applicable law, purchases are final once the purchased credits have been used.

5. Acceptable Use Policy (AUP) & Content Standards

We are committed to providing a safe, lawful, and responsible AI-powered creative environment. All users must comply with this Acceptable Use Policy.

5.1 Content Standards & Prohibited Categories

You are strictly prohibited from using the Service to generate, upload, process, or distribute content in any of the following six categories:

  1. Pornography / NSFW Content: Sexually explicit, pornographic, obscene, or adult-themed content, including nudity, genital depictions, and sexually suggestive or erotic acts.
  2. Violence / Gore: Content depicting graphic violence, bloodshed, gore, severe physical harm, mutilation, self-harm, cruelty, or content that incites, glorifies, or promotes violent acts.
  3. Hate Speech: Content that attacks, denigrates, dehumanizes, harasses, or incites hatred or discrimination against individuals or protected groups based on race, ethnicity, nationality, religion, disability, age, sexual orientation, gender, or gender identity.
  4. Child-Unsafe Content (CSAM): Any child sexual abuse material (CSAM), sexualization of minors, or content that exploits, endangers, abuses, or harms minors in any manner. We maintain zero tolerance for child exploitation.
  5. Deepfakes & Impersonation: Generating images depicting real, identifiable individuals without their explicit written consent, creating deceptive deepfakes, or misrepresenting AI-generated imagery as authentic, unedited photographs of real individuals or events.
  6. Copyright & Trademark Infringement: Content that infringes upon the intellectual property, copyright, trademark, design patent, trade dress, privacy, or publicity rights of any third party. You must own or possess all requisite licenses and rights for every image, logo, and asset you upload.

5.2 Absolutely Prohibited — Zero Tolerance

We enforce a strict zero-tolerance policy for:

  • Child sexual abuse material (CSAM) or any exploitation of minors.
  • Content that promotes, incites, or facilitates terrorism, violent extremism, or mass casualty events.
  • Instructions or designs for weapons, explosives, or hazardous materials.
  • Non-consensual sexual deepfakes or harassment targeting real individuals.

Any attempt to generate zero-tolerance content results in immediate account termination, forfeiture of credits, and referral to relevant law enforcement authorities where appropriate.

5.3 Prohibited Platform Conduct

You also agree not to:

  • Interfere with, compromise, or disrupt the operation, security, or infrastructure of the Service.
  • Access the Service using automated bots, scrapers, or crawlers without prior written authorization.
  • Attempt to bypass, disable, or circumvent safety filters, rate limits, access controls, or prompt-moderation safeguards ("jailbreaking").
  • Reverse engineer, decompile, or extract the source code or proprietary weights of the Service or its underlying AI models.
  • Resell, sublicense, or redistribute access to the Service without prior written authorization.

6. Content Moderation & Enforcement

To uphold our Content Standards, we deploy a multi-tiered content moderation architecture:

  • Automated Real-Time Screening: User prompts and uploaded images are scanned prior to generation by automated safety filters to detect prohibited categories. Output images undergo automated safety evaluation before being rendered.
  • Human Review: Flagged requests, edge cases, and user reports are routed to our Trust & Safety team for manual review.
  • Severity Levels:
    • Critical (L1): Child safety, terrorism, severe threats. Action: Immediate block, permanent ban, credit forfeiture, and law enforcement referral.
    • High (L2): Serious violations such as non-consensual deepfakes or extreme hate speech. Action: Immediate content removal and account suspension.
    • Medium (L3): General policy violations (e.g., adult content, unpermitted trademark usage). Action: Content removal and formal warning.
    • Low (L4): Minor infractions. Action: Warning and guidance.

7. User Reporting Channels & Handling Procedures

We provide clear, accessible channels for users, rights holders, and the public to report violating generated content or policy infractions.

7.1 How to Report

If you encounter content generated through our Service that violates this Acceptable Use Policy, infringes your rights, or depicts you without consent, please notify us:

To expedite investigation, please include:

  1. The URL, image identifier, or file attachment of the offending generated content.
  2. The specific violation category (e.g., CSAM, hate speech, violence/gore, copyright infringement, or unauthorized likeness).
  3. A concise description explaining why the content violates our policy.
  4. For intellectual property or likeness complaints, documentation proving your identity or ownership rights.

7.3 Processing Workflow & Response Timelines

  1. Receipt & Acknowledgment: You will receive an acknowledgment confirming receipt of your report within 24 hours.
  2. Triage & Classification: Our Trust & Safety team assigns a severity level (L1–L4) and initiates an investigation.
  3. Turnaround Times:
    • Critical Violations (L1): Initial response within 2 hours; resolution within 24 hours.
    • High Violations (L2): Initial response within 24 hours; resolution within 3 business days.
    • General Violations (L3–L4): Resolution within 3 to 7 business days.
  4. Enforcement & Notification: Upon confirming a violation, we take immediate corrective action (content removal, account restriction or termination) and notify the reporting party of the outcome.

7.4 Appeals

If you believe your content was removed or your account was actioned in error, you may submit an appeal to support@photoshootgenerator.com within 14 days of the decision. Appeals are independently reviewed by a senior member of our safety team.

8. Your Content

You retain full ownership of the images you upload and the images you generate with the Service. You are responsible for ensuring you have all rights required to upload your images and to use the generated results.

Commercial use of generated images — in product listings, ads, and your own store — is available to paid users: accounts that have purchased credits or hold an active subscription. Results produced by free trial processing, including the anonymous first swap, are for evaluating the Service.

You grant us a limited, worldwide, non-exclusive license to host, store, reproduce, process, and display your uploaded and generated images solely as needed to operate and provide the Service to you. This license ends when you delete the content or close your account, except for backups and records we are required to retain.

9. Our Intellectual Property

The Shotelle name, logo, design, text, graphics, software, and technology are owned by us or our licensors and are protected by intellectual property laws. These Terms do not grant you any right or license to use them except as expressly permitted.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that generated results will meet your expectations or be suitable for any particular purpose. Identical inputs may produce different results between generations.

Nothing generated by the Service constitutes professional advice of any kind.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost data, lost revenue, or lost profits — arising from or related to your use of, or inability to use, the Service.

Our total aggregate liability arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service at any time if you violate these Terms, if we reasonably believe your use of the Service creates legal risk, or for other legitimate reasons, with or without notice.

Upon termination, your license to use the Service ends and your right to access your account and content ceases. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — survive.

13. Changes to These Terms

We may update these Terms at any time. Updated Terms will be posted on this page with a new effective date. Your continued use of the Service after updated Terms take effect constitutes acceptance of them.

14. Governing Law

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law principles. You agree to comply with all laws applicable to your use of the Service.
